Exploding bullets legal to use?

My friend makes an exploding flare like 9mm bullets. Shoots from a hand gun.

I shot a few and it's like it has a delayed flare like detonation about a second after it hits a target and burns for about 3-5 seconds and explodes.

What can this be made out of? Magnesium?

Is it legal to use? If it is legal and you shoot someone with it, can it be thought of as excessive force?

They are  called "tracer rounds" and you have to have a special permit to use them.

im sure any kind of bullet that is created at home is illegal

Its illegal, as if you shoot someone with that, you could kill them or injure them more severely then a normal bullet would. Also depends what you are using it for.

Anything that explodes is going to be illegal.

Magnesium creates a burst of light, but will not explode or create 5 seconds of fire. there must be more to it than that.

Because they are illegal, there will be legal issues with self defense. Even if you are not charged criminally, the use will result in an almost certain lawsuit.

The short answer to your question is no.  However, there is a much more serious question you need to ask yourself.  When you end up shooting someone in self defense what are you going to tell the District Attorney General was your excuse for having exploding bullets if you did not have a pre-meditated plan to use deadly force at that time in that place where you had these for your personal use.  Besides, you will find a well place .45 or 9mm will do just fine.  There is people out there that hollow out points on rounds and put a waxy substance over it after the bullet is filled wtih mercury.  It is almost a sure way to State or Federal Prison if you are in the wrong situation.  Fun for play, but not for use in a real defensive fight.
