Fare evasion on trains?

Hi, one of my colleagues at work has received a summons for fare evasion. However he needs to be criminal record cleared for work, and if he pleads guilty/found guilty he'll receive a criminal record. Does anyone know of any loopholes or exceptions that he may get off on?

I know he shouldn't have done it, and I don't know the full circumstances, but was wondering there's anything he can to wriggle out of it?

  1. He can't get out of it, he is going to get a criminal record whether he likes it or not.


  2. If he can demonstrate that he attempted to get a ticket but couldn't for some reason, that might wash.  Without knowing further details, I can't really comment.

    He really needs to employ a good solicitor, which may be expensive.

    To be honest, if he has a full time job, is seems a bit silly to evade a fare on a train.  Not much different from theft, really.

  3. It's possible that if your friend comes off truly sorry and willing to pay any fines or penalties that the judge may drop the charges.

    It's probably a misdemeanor rather than a felony.  A misdemeanor on his record, while bad, isn't anywhere near as serious as having a felony conviction.

    He may want to explain the consequences of a conviction to the judge.  If his record was previously clean, the judge may be lenient.

  4. Don't worry bout it. Well.... If the job he wants is with the police he's probably lucked out there as they don't accept criminal records. If he's joining the army they have a system that means a period of time has to pass after a criminal offence and they'll let you apply after that. For most other jobs that require police checks this kind of crime shouldn't really be a problem as they are generally looking for crimes of abuse.
