Flawed DVD?

Question

I got a DVD from ebay about 3 months ago for a christmas present, and it was brand new and sealed and today I descovered it has a small flaw on it. It's like something was on the DVD when it was recorded. Anyway, assuming the seller on ebay has no obligation to replace it since it's outside the time for returns (I'm being pessimistic!) do DVDs come with any sort of guarantee? Is there anything else I can do?
