Form 8379 and Incentive Payment?

My spouse's incentive payment was taken by the IRS to pay part of an old business obligation solely of mine. An IRS employee told me to fill out an 8379 form for her. The form has spots for all the amounts from the 1040 form, but no apparent place for the incentive payment information.

How do we fill out this form properly so my spouse can get her share of the economic incentive payment?

  1. The IRS does not give guidelines for this situation.  However it would appear that you should complete parts I and III and write stimulus incentive only across part II.  There are no specific rules as of yet but it appears that the IRS will send her 50% of what the two of you would have received.  It will take about 14 to 16 weeks for this to happen.


  2. If you are doing it just for the incentive payment:

    1.  Write "stimulus payment" at the top.

    2.  Part 1.

    3.  Part 3 (she signs).

    4.  Mail.

    5.  Allow 14 weeks....

    No matter what state you are in, who made the money or would have claimed the children, the stimulus will be split 50-50.
