Green card application?

Anyone who has a personal experience.. im about to apply for a green card thru legitimate marriage my passport is expiring the end of this december is this a problem? can i still apply or do i have to renew before application im planning to renew it before i get interview but i wanna hand them my application now. And how long does it take to get interview after you apply and after how long do you get the GC in mail?

Your passport expiring won't be a problem in terms of the Adjustment of Status application. There are no rules or requirements for there to be a certain period of validity on the foreign passport.

For the application you need to submit, among other things, a photocopy of the biometric page of your passport, a photocopy of the visa in your passport and a photocopy of your entry stamp in your passport. Once you have taken a copy of these things, you can go ahead and renew your passport. If you happen to have an interview before your new passport and old passport are returned to you (very unlikely) and you are asked for the I-94 card from your passport, just explain that you are in a renewal process.

The time frame from application to approval varies on a case by case basis. Many things can affect the time, such as the background check, any periods of overstay and so on.

It could be anywhere from 6 months to 3 years.

As a side note, not all applications for Adjustment of Status will require an interview. After the application has been received by the National Benefit Center (NBC), the I-485 part of the application could be sent to the California Service Center (CSC) for processing rather than to your local USCIS office. Although not guaranteed, it's less likely you'll be called for an interview if you have your case transferred in this manner.
