Grocery Store claim: What's next?

Yesterday my wife slipped and fell at a local grocery store. They're a chain, so I know they'll have liability for it. The place where she slipped there wasn't any water or anything, just the floor wax was a little thick and hadn't been buffed out properly. The manager came and called EMS; they came and we went to the ER. Turns out my wife fractured two bones in her leg near her ankle and there will need to be surgery to fix it.

What I'm looking for is advice. I need to know what to do next. I've called the store, they say I need to call back during a time when the manager who was on-duty during the accident is in the store to fill out an accident claim. I need to schedule the surgery asap, but do not have third party insurance coverage (i'm a college student, she's a recent grad). I need them to pay for it, as well as (hopefully) some monies to cover the cost of living and such as she makes more than I do and will be unable to work for the next 6-8 weeks.

  1. Yeah, you really should be getting an attorney.  He/she will advise you on what steps to be taking, and should even communicate with the company on your behalf ~ which I think is adviseable.  


  2. Instead of calling the store you need to call their corporate office and a lawyer. Since EMS were called and took her away you have proof of the injury wihtout the manager. But call and talk to a lawyer and at least get a consultation of what your rights are. You do deserve the help you need!

  3. Lawyer will file a personal injury claim for you, and the store will eventually have to pay. You can, however, help your case by collecting as much info as you can: pictures, immediate statements, witnesses, changes the store made that day/next day, statements made later, medical reports, EMS statements, etc.

    By the time these things go to trial, memories fade, evidence disappears, witnesses are hard to find...

    The corporate HQ lawyers should know that offering to assist with your immediate medical expenses is not evidence that they were negligent.


  4. Document the entire incident that happened: this includes you and you wife's version of what happened, call a attorney to handle the case because from what you explain it's an obvious case of negligence. Make sure that you have all the medical records in order because you will have to take this to the attorney in the first consultation. I recommend to have your documents in a file folder in chronological order (most recent on top). When the attorney takes the case, he/she should request video recordings from the grocery store.   5. You can try the road you are currently traveling but you may not get the immediate satisfaction you seek, not sure the store at this point will even admit liability, without an agreement signed off by the both of you

    You may need to seek out a personal injury lawyer to get the appropriate recourse
