H1B Visa Renewal?

My first H1B Visa term expries in March 2008. When should i start filing for the renewal ? i am working with the same company. also, what is the cost of the renewal 1) Attorney fees 2) CIS fees , should there also be a user fee which the company pays? ( already paid the first time)

  1. Definitely, your company should be taking care of this, unless you've given them some reason not to. However, don't assume they've watching the clock and know when your visa is up. Go tell them and talk to them about what needs to be done and what they're willing to do about it. There are times when the length of the visa validity doesn't match the petition validity. Depends on what country you're from and what the max period for your type of visa is. It's called reciprocity, as basically, it's do unto you as your country does unto us. If your country only allows US citizens a one entry 3 month visa in this type of category, well, that's all we'll give you as well.  The company can extend your status in the US by doing the paperwork with USCIS, but if you want to go back home, and return, for Christmas, let us say, you'll need to get a new visa. Once you're in the US, you're good to stay as long as you're in status, but if you want to go in and out of the US, you need a valid visa.  Go talk to your HR department as soon as possible and get the ball rolling.
