HELP!!! ebay question / paypal?

ok i bought a phone off of ebay on dec 16 and on dec 17 the seller emailed me saying he will be sending the phone out whit in 24hr and he gave me a tracking number so heres my problem when i track the item USPS they tell me that there were electronically notified by the shipper on Dec17 to expect your package for mailing. This does not indicate receipt by the USPS or the actual mailing date meaning the shipper didn't evin mail the package yet so i emailed the shipper and told him wat goin on he replied and told me he mailed the package and he will open an investigation whit the USPS but i was expecting this package to be here be x-mass so now thats its not going to i want to get a refund and buy the phone from a local store but theres no way to get in contact whit the seller not evin by phone so how do i get my refund from paypal or ebay or someone help...

USPS Delivery Confirmation is NOT tracking, so looking it up online means nothing - but it does tell you that your Seller made a postage-paid mailing label.  So when Seller tells you that he mailed it, the evidence supports it.

The next question, then, is HOW did it go?  If it went Priority, then you're in good shape for Christmas delivery. You should get it on or before Monday.

Your Seller by law (called the "mail order rule") has 30 days to ship your product.  We already know it's on it's way, so you don't have any reason to demand a refund.  

You have to be aware that the mail is busiest during the holidays, all the way up Christmas -- the news tells that same story every year, every channel.  So you waited until the week before Christmas to order something you wanted not just BY Christmas, but apparently in three or four days.

You're not going to get a refund, so relax.  Just wait for your mail to arrive and enjoy your new phone!

Just Wait A Bit longer ...... Keep checking the Tracking Number to see where the Package is and If you need the Phone B4 it gets to you go buy the One you Want and resale the One you Got on ebay ..... It is not fair to the Seller to Give you your Money back unless  the phone Was Lost. ..... Now if the Seller did not Send the Phone then you can Open a investigation though Pay-pal and they can decide if you should Get a refund or not.

The tracking system for the Post Office is not very good. By the time the updated information shows up online for U.S.P.S. you will already be talking on the phone. From experience I've noticed that the Post Office doesn't show any activity on their tracking except that they received notice of intent to ship and receipt of shipment. It's not like U.P.S. or FedEx where you see the progress of the package. I would give it more time.
