Have I been laid off unfairly?

I have worked for a company for a little over 3 years. My boss for most of this time retired and was replaced with a lady who didn't seem to like me very much. I am a responsible young adult with bills to pay so I continued to be a dedicated employee.About a year ago the new boss hired another girl and would often train her on things that she would refuse to train me on even when I asked. I also trained this new girl because she came in with no experience. I've been getting weird vibes over the last few months that the new boss was planning to get rid of me. Today after returning from my break I was laid off. The reason given was they weren't busy enough. Am I wrong to think that it should have been the new girl to be laid off if this were the case?

Honey, the truth is the new girl was probably there to replace you to begin with.  You got weird vibes from her because something in your subconscious knew this was true.  Unfortunately, unless you know you got laid off for a discrimination, you can't sue the company for even a penny.  You can, however, apply for unemployment!


  2. This isn't uncommon,  I was "laid" off back in 1994 I was the manager and in a short time most of my staff had been let go.  Most of them not to their fault, just because I had hired them.

    You aren't wrong in thinking that it should have been the new hire, but it's not your choice.  The boss made her choice.

  3. you may have been laid off unfairly.  However, unless you have a contract, you are what is known as an "at will" employee.

    That means that either you  or the employer may terminate your employment at any time for any reason.  so if you were laid of for any reason, then it probably wasn't illegal.

  4. I'm sorry for you.  I was "laid off" due to "downsizing" after 20 years of service because my boss hired his mistress.  It's so unfair.  Just do yourself a favor & move on - don't beat yourself up over it, it's probably their loss anyway.

  5. Definitely, though without knowing your work ethics I cannot say for sure.  I can tell you, that being laid off to lack of work should have resulted in the termination of the newest employee.  

    It sounds like there was some hostility between you and the boss, though, so I would say for sure, that it's not a reasonable cause for termination.  

    I would suggest going to unemployment and then the labor board if you really feel wronged.

  6. You can be laid off for any reason.  The only thing you can really do is to file for unemployment and find another job.

  7. From what you've said, it does sound like you've been let go unfairly.  Unfortunately, these things happen entirely too frequently.  Depending upon if this is a sole proprietorship or a branch of a larger company, you may be able to appeal to your human resources department.

    Depending upon where you live, you may be entitled to certain severance benefits.  Check out your company's policies and compare them to those guaranteed to you under your state's guidelines.  Without knowing what that state may be, it is hard to direct you, but a simple google search should give you some good results.

    Make sure that even if your dismissal is unfair, the terms of it are legit.  Don't let them cheat you out of anything that you are entitled to.
