Hit by a car?

I was crossing an intersection in a 4 way intersection with my bike, and this guy from the other side tried to speed his way to make it before i passed, and he hit me pretty hard and my bike is completely messed up. Luckily, i'm injury free, but i do feel some pain in my right knee (side that i was hit). Will my bike be payed for? Will i be able to get a new bike?

note: this bike is a specialized, and cost $600

  1. Did you call the police?

    Did you get his name, insurance info, etc.?

    Did you go to the hospital?

    If yes to all of them, then you should get paid easily.

Assuming you have a police report and all the drivers information including his insurance company and policy number along with the tag and VIN off his car, all you will need to do is contact his insurance company, report the accident, and make a claim.  You won't get what the bike cost, you will get whatever it was worth just before the accident, the fair market value.

  3. Yes your bike should be replaced...follow these instructions and if you need to email me any questions you may have;

    You need to make contact with that drivers insurance company and inform them of what happened, tell them you are injured in that you feel stiff and uncomfortable now and that you need authorization from them for you to seek medical treatment... They should assign you a claims adjuster and a claim number, write this down.

    I recommend you visit a chiropractor and get yourself checked out because I know you could use some adjustments to make you feel better, I praise the ground they walk on... anyway go see a chiropractor and give them the claim number and the insurance companies name and the name of your claims adjuster and he should be able to treat you as needed and bill the insurance company...

    Now comes another point, the insurance company is going to pressure you for a recorded statement, this is not required and will only be used for them to try to manipulate you into saying something that could harm your claim, so you DO NOT give them a recorded statement, tell them you are not going to give a statement at this time.

    That way you've implied that you may later, but now your only interested in getting treatment for your injuries and replacement of your bike...

    Tell them that you were hoping to resolve this without retaining an attorney, this should please them... then a replacement check for your property damage should come quickly, they want to settle that fast as they want you happy when it comes time for you to finally settle with them.

    Once you've finished seeing your chiropractor and a final bill has been rendered to the insurance company for payment, then they will be in contact with you to offer a settlement...

    They will lowball you, decline that offer they will increase the offer immediately by maybe 1000, decline that also and tell them that you were hoping to resolve this without an attorney, but if they don't come up with something more reasonable you'll have to retain an attorney to settle this for you...They may want to call you back.... Your final settlement should be about 2 to 2.5 times your medical bills....

    So the higher your medical bills, the higher your settlement will be...

    You should have a nice check coming, and by settling it yourself, you can save 1/3 of that settlement in attorney fees, if you feel like you want an attorney by all means go get yourself one, but DO NOT allow the insurance company to get a recorded statement from you... If you finally come to an offer you both agree on, they will send you the paperwork in the mail, read them and take them to a notary public and have your signature notarized on the documents, then send them back the insurance company, then a check will follow min about 10 days or so...

    I've settled over a half dozen Personal Injury claims myself, and my attorney friend told me he couldn't do better for me that I've done for myself... Good Luck and get yourself checked out...Peace
