Home study and court date?

Just had a home study. It's an open adoption. Parents have signed relinqueshment of parental rights 3 months ago, had background check, baby has been living with me since newborn so almost 10 months. Question is once homestudy person completes their recommendation for the court how soon on the average does it take to be assigned a court date?

  1. With my friend and my sil, I dont know when they assigned it, but the court date was a few months later.... Good luck and I am sooo happy for you!


  2. It depends upon the schedule for the court and judge.  Our home study was completed before the placement, with the exception of the post-placement visits, and the court date was about three months after the placement.  It could have been earlier, but the judge was busy with other cases.

  3. If your adoption was private through and attorney, then it's the courts and social services that may be holding things up, especially since it has been 10 months since placement. Usually, you have 3 post adoption visits from a social worker after placement. Once this is completed, then it usually does not take longer than a month for a court date to be set. If you are working with an agency, the same applies, so either contact your attorney, or the agency and find out what is going on. Each state is different. Some require you be "in court" on adoption day, others do not.
