  1. 1. If the mother charges her mind within a certain time period.

    2. If she tracks down the father and gets him to help her contest, as most adoptions go on without the biological fathers consent.

    3. If abuse in the adoptive home can be proven the biological parents might have a case.

  2. okay in order to answer this question we need some more information. How long has it been since the rights were signed over. Did you parents adopt the baby or was it someone you are not related too. What state are you in? Has the father signed over his rights and when. Were you forced to sign over your rights or were you under the influence of medications from birth?  Okay if you tell me these things I can tell you what the laws are. Yahoo answers won't let me answer more than once so if you would like me to answer your question you can contact me from my profile page.

    Good luck,

  3. If your talking about getting your child back then:

Unfortunately, it going to come down to money. You do have the chance no matter what anyone tells you here about the ink.

You need to find a bad a*s attorney that will use every loophole to drag the a-parents to court until they finally give up or the system is convinced that your child should be with you.

If you did deep enough and touch the heart of the right attorney they may actually wave the fee's if the PR out way's the money you would have to pay them.

It will be tough but at least your child will know you fought and was held hostage.

    Good luck.

  4. Dear Mommy,

    It depends on the situation.

Scenario 1: One or both First Parents rescinds the relinquishment within the allotted time frame for them to do so and stops and adoption in progress. (Unfortunately, this often results in cases like the Quetts case and the Bennett case.)

Scenario 2: The Adoptive Parents decide for whatever reason, they do not wish to parent the adoptee and "disrupts" the adoption and returns the child to the agency or foster care.

Scenario 3: The Adoptee wishes to no longer be adopted. An adoptee cannot do anything except get a legal name change and essentially "disown" his or her APs. (Um, hello rights?! Seems to me that THEY should have the ultimate say here!)

Scenario 4: DSS/CPS becomes involved in a case of abuse or neglect and terminates the Adoptive Parent's parental rights through the Court.

Scenario 5: The adoption itself is fraudulent and can be annulled by the Court after proper proceedings. This can be requested by any party but has no guarantees that the Court will agree.

Sorry I can't be more specific to your Q without details.

  5. Has the revocation period passed and the first parents rights been terminated?

If so, then the adoption is finalized and permanent.

  6. It's hard but YES if the birth mother hids the fact that who the father is and his rights. IN fact he can stop the adoption and sue you and the agency and the social worker. My son just went through this and he settled a lawsuit with the social worker, adoption agency and the whata be adopted couple.

Play it safe get's father's permision and if he says no get out of it and find another child could end up costing you more that you want.

  7. Depends on Where are you located?

  8. If the birth mother signs a relinquishment there is no going back.

On other adoptions there is a certain time period but it differs from state to state. I would call an agency in the state that the adoption took place to make sure.

  9. only if you can prove that it was done by using fraudulent or if the parents were forced or pressured into it.

It is just like giving birth - you don't get to give the baby back.
