I want to kill a thief ?

My car was broken into. Luckily the thief broke only the small window which cost me like 80 dollars to repair it. I am so d**n pissed off. Because the car is just parked outside my window, say the thief strikes again, but before he can do it I shoot him with my gun. If he or she dies will I be liable for their death and will I be prosecuted? Shoot that person deserves more then to die they deserve to rot in h**l.

Yes you will be prosecuted.  If the thief was inside your house, you can shoot that person and it will be considered self defense.  However some lawyers can actually argue that you didnt really need to kill that person.  When this person is outside and attempting to steal your vehicle, you cant shoot him or her.  You can scare him or her away.  Brandish your pistol if you must.  But you cant shoot this person.  He or she is not endangering your life.  You will be committing murder.  

I do know how you feel.  I hate thieves.  I would want to shoot them myself if they tried to steal anything from me.  But unfortunately for us law-abiding citizens, we cant shoot these low lives unless they are inside your house or actually holding a weapon and attempting to kill you.  Trying to steal your car isnt a reason to kill the thief according to the law.  You can shoot him or her if he lunges at you though.  I am pretty sure that is considered self defense.  But I am not a lawyer.  I just know some of this through common sense and conversations with people that are in the legal field.  

I know for fact that you can only shoot someone if they step into your house to rob you or harm you.  Outside of the house, you are required to call the cops to resolve the situation.  I dont think anyone is going to sue you for coming outside and brandishing your weapon though.  And I think that would scare the thief away.  But this can be extremely dangerous.  They might shoot you if you show them you have a gun.  You might be better off just calling the cops.

My suggestion is to call the cops.  Dont brandish your weapon.  On second thought I think that would be dangerous.

Hey. that really sucks. But. You can get into alot of trouble for shooting them. Its only OK to shoot someone if they try to kill you.

Shooting someone for pissing you off unfortunately is illegal. You can go to jail for manslaughter.

Maybe if he hurt someone you love. But going to Jail for a long *** time over 80 dollars. Thats not worth it.

Killing someone who isn't threatening your life won't be seen as justifiable homicide, even if they are breaking into your car.  If you're in the car and getting carjacked, you have a case, if your gun is legal.

Killing them before they do anything will get you charged with murder.

you cannot, your never allowed to use deadly force unless to protect your own life, if a theif broke into your house and drops your tv on his foot he can sue you, the law always works for the wrong guy they have just as many rights as you even during the act of violating yours

IN CALI YOU WOULD BE CHARGED WITH 1st DEGREE MURDER AND WITH THE POST OF YOUR QUESTION THEY COULD EVEN PROVE THAT IT WAS PREMEDITATED. Depends on what state you live in, but most states do not allow you to use deadly force unless it is to protect yourself from harm... not your car.

Some states do allow you to use deadly force to protect your property.

Shoot him in the leg. That way you can probably get away with it. Killing someone over 80 dollars seems a little extreme anyway. He may be really poor and trying to get money for his two three year old children so they can eat. I'm not justifying crime but at the same time if you shot him over 80 dollars and then found this scenario to be the case wouldn't you feel a bit guilty?

I'd recommend you reconsider; you have already admitted premeditation and that makes what you are considering murder.  

I can understan your anguish, but your insurance should cover vandalism; get a police report on any future incidents and then call your insurance agent.

Is a busted window or even the car worth all the risks involved in getting physical with some punk or the problems which will probably result from shooting or killing some bottom-feeding scum of society? I think not.  Leave this type mission to another of the vandals victims.

In Texas you could. Texas lets you defend your property. A state like Arizona, yes you would be charge. In Arizona you can defend your life or the life of others and not your property.

It's understandable that you feel violated and angry. But shooting someone is something you can never erase from your psyche - or legal record. Talk to a friend about your feelings instead.

A car is not a human life.  Get an alarm or a video camera and just have him carted off to jail where he belongs.

You do not have the right to kill a thief UNLESS he is trying to kill you. If you killed the thief YOU would go to jail AND he (if he doesnt die) or his family will probably and/or can SUE you for damages and win.

All you can do is set up a video camera and catch the thief in action or call the police if you see a thief. If you shoot them you will go to jail especially if you dont have a license to carry a firearm. Dont shoot anyone unless someone breaks in your house and you feel like they are going to kill you or rape you and they have a knife or gun.

You have two things to consider, first if you shoot them and do not feel that your life is threatened then you may be charged.  Second, if your car is not parked on private property they are not trespassing either.  You will be charged.  The best thing to do is to call the police or add theft insurance to your car.

In Texas, we have the Castle Doctrine that says you can protect yourself and property.  h**l, at night, if someone is up to no good on your property, you can drop them and be free from prosecution.  You may still get true billed but it'll be dismissed.  You're covered.  My advice?  Leave the commie state of California and move to a state where your rights are more important than a thief's.

no matter how you put it, you are admitting or considering premeditated homicide, or murder.

It's fine to be angry and set up surveillance to catch the perp. but shooting a thief outside will get you locked up also. And you may even be sued by the thief or his family. If he broke into the house and attempted to harm you, then it would be justified. But him not attacking you. then you are not defending yourself. And that would be unlawful use of a gun. If you have a gun, you should've taken the training, and learned the laws before getting a license, thus you should know by now that your actions would be unlawful.
