If injured on a job , And alawsuit is settled, And that person has no Liability Ins, Does the party that hired this contractor become responsable for the liability Ins. When a builder hires out to Sub contractors, Arn't they resposible to make sure they are covered by Comp& Liability

  1. OK, if you're injured on a job, WORKERS COMP is what kicks in, not liability insurance.  If the sub doesn't have workers comp, the general is on the hook for benefits. If the sub and the general both don't have workers comp, you can always go back to the property owner.

    Not having a policy, does NOT mean you're "off the hook" for benefits.  The problem with contractors is, they can just file bankruptcy, and you'll never see a dime, even if you get the judgement.  But you can still go after the property owner.

    Your lawyer should be advising you on the laws for YOUR STATE, as it's highly state specific.

As an add to the other answer, most states have some sort of Special Fund to pay work comp claims for employers that do not have coverage, the state will then go after the employer to pay back the costs of the claim.  If you are looking for some sort of big payout, forget it.  There is no pain and suffering payments in work comp, and no punitive payments either.   You generally don't settle a work comp claim until you are MMI, you are as good as you are going to get.
