Inter country adoption?

We are a couple and our ethnic origin is India, We have been living in UK since June 2004. We are in UK on Work Permit Visa till Oct 2009. And our visa specifies that we have Limited Leave to Remain in UK .We are going to apply for the Permanent Residency for UK in May 2009. My husband works as a Senior Radiographer with NHS. We were married on 1 Dec 1999 and have tried for a child since then but I have a history of recurrent miscarriages each time I have conceived. So, now we want to go for adoption as we have always yearned for a child. We will be interested in adopting a child through interCountry Adoption from India.

We are in London and I contacted my local council but they are reluctant to help us as we don’t have indefinite rule to remain. another voluntary organisation said they can help us if we can prove we are habitually resident in UK. Please advice on legal and immigration rules applicable to us if we adopt from India and try to bring the child here.

  1. I don't think you'll be able to do this in the UK. It is much more difficult to adopt internationally from the UK because the UK has much stricter regulations in place to protect the rights of the child

    Because the USA does not have such stringent regulation, Americans can get away with the most horrific violations of childrens rights and, thus, it is far easier to adopt internationally from the USA

    Ever fancied living in the USA?  (joking)

    I'm sure that if your residency situation becomes permanent you may be in with a better chance.  Having said that, there are so many children waiting in foster care for homes the authorities will probably insist on adopting from there before they will allow an intercountry adoption.  And this is as it should be (anyone in the USA listening?  no, they don't care lol!)

  2. To Heather H.  What are you inferring. There are many reasons why I would not and did not adopt from within the US. Intercountry adoptions are great as those children need an opportunity for a better life as well.

    I have adopoted two children internationally and would be happy to debate you at length on the pitfalls on intra-country adoption in the US.

    To the op. I can not offer any advice here but wish you the best of luck in your attempt to become parents. It is a great joy.
