Is a DUI a misdemeanor?

  1. Depends on where you get caught doing it. States differ, and federal rules (military bases, national parks, etc) are also different. In reality, the charge (and penalties) for DUI should be the same as shooting blindly into a crowd of people: reckless endangerment (assuming no actual intent to kill, and nobody is actually hit).  If anyone is injured it's aggravated assault with a deadly weapon; if someone is killed, it's manslaughter.

    but it shouldnt be if it is.

    people on dui should be followed by the policies of a civil government.

    ive heard too many horror stories if a person gets caught he probably has 50 violations.

    if he gets a repeat offense it doubles how many times he didnt get caught

    and if he still continues to violate the laws of safety ive heard of several people who finally got caught after they killed someone.


  3. I"m not for sure for sure, but I'd say it could be but it sounds more like a felony... why did u get a ticket for that? ask your local county and maybe as a cop? best of luck

  4. Depends on the cirumstances, but generally yes its a misdeedmeaor.  Repeat offenders are generally escalated to be charged with felonies.  Every state has their own laws regarding Driving while Intoxicated Impaired and the lesser offense Driving while impaired.

    For example in NY driving over the limit of .08 is considered a class A misdeemeanor, but a subsequent offense within a 10 year period you will get charged with a felony.
