Question:

Is this a good revenge?

I had a contingency contract to buy a house but the realtor gave the sellers a loop hole which they used to bump me off and accept a higher offer. After I lost the house,the realtor did not tell me and I was kept in the dark while the lawyer she recommended asked me to make a decision as to whether or not to pursue a cross contingency to keep my current house if the deal they knew had fallen through fell through(The lawyer also hid from me the deal had fallen through and I had to make that decision without being told the deal had fallen through). When I made the decision to keep my house if I lost the deal I did not know I had lost,the realtor called to tell me that may bust the deal and I should not have done that because she could have found me something else. She knew I had no family but my child and we would have no where to go and would be forced to take any hole she wanted to sell me. I wanted to still sell to the people that want to buy my house but would need another contract to buy since we have no where else to go. The realtor represents both me and the buyer and she has been ignoring my requests to look at other houses to get another contract in place so I can sell outright and complete the transaction. I suggested a sale but with a contingency to find another home by a specific date but the realtor and the buyer's lawyer are working together and she is suggesting a rent back situation instead. I think she is doing it to sell and get her commission(none without a sale) and help the buyers, whom she knows personally, amass a couple thousand after the sale . I am really disgusted with the whole situation and afraid if I agree to the rent back situation I may not find a nice home in a good area(There are some heavy crime areas near by) and many of the houses I saw before I found the one I lost are fixer uppers-which I can't afford to fix. I am thinking it's not right for me to sell and risk ending up in a dive of a place and am angry the realtor's loop hole cost me the house I wanted. I am also angry that she has been ignoring me since the other deal fell through instead of helping me find a place so I can sell having a place to go to. I am thinking if the lawyer/buyer comes to me with a rent back counter, I am going to say thanks but no thanks and take the house off the market and get her contract cancelled so she doesn't get a penny and I am free to find someone who has my best interests at heart to help me sell my home and buy a new one. Is this a good revenge?

  1. 1.  Get your OWN attorney to look out for YOUR interests!  NEVER use an agent's or seller's attorney (other than for the mechanics of the closing) as they cannot and will not be looking out for your interests.

    2.  Consider reporting the agent/broker to your State Board of Realtors.  On the surface, it appears that they are being less than honest if not outrightly breaking the law.

    3.  If you decide to sell, keep in mind that you are under no obligation to rush into a purchase.  You can always rent something temporarily while you get yourself sorted out and find the right place for yourself.


  2. It sounds like you are no longer comfortable with your realtor or the way that they conduct business.  That is a perfect reason to 'fire' your realtor.  Don't agree to the lease-back and hope that they buyers then back out.  Then cancel the sales contract.  Don't be surprised if this realtor tries to sue you for the commission since they brought a willing and able buyer to you.
