about a week ago an officer pulled me over, to make a long story short he ended up telling me that "it was my lucky day and to go home" 8 days later after that I receive a ticket in the mail by this officer with a summons to go to court. The officer did not tell me that he was giving me a ticket while i was there. Is this still valid? Also my letter came to me through regular mail, its from the county courthouse. It says in the letter that if I dont appear on such date a warrant will be issued for my arrest. Can they do this? My letter wasnt certified, therefore the court cannot prove I got this letter can they really do this? I thought letters from the courthouse should be certified or delivered by the constable right? Also I didnt sign this ticket.

  1. That seems unusual, but it is legal. I'd be interested in what you were stopped for, and what the ticket was for. It is possible he discovered something after you were released.

Mailing the citation is legal. If you show up, that proves you got it. If you don't show up, they will not dismiss the ticket. They will either issue a warrant, suspend your license, or both. They will then serve your court papers personally, and probably add the costs of service to your court costs.

As far as not signing the ticket, that is just to confirm you received it. That does not affect the original charge. The same thing applies as I described above.

  2. valid ticket

better show up or your license will be pulled.

  3. Knock, knock. They don't have to prove you got the letter. They can just issue a warrant for the traffic offense. Why should they certify the letter? When you got your license, you promise to keep the state current on your mailing address. Too bad on you if you don't get their mail because you failed to do so.

As to the ticket, I guess he changed his mind. Maybe he was out of citations. And to say you can't be charged because you didn't get a ticket on the spot is like saying you can't be charged with any crime unless they see you do it and arrest you right there. Treat it as a regular old ticket.
