Lakeview Terrace scene: is this legal?

In the new movie "Lakeview Terrace" there is a scene where the main couple are being 'intimate' in the pool in their backyard. It cuts to their neighbor who pulls his kids from the window. The voiceover is the father telling the couple that he'd rather not have them 'put their bedroom scenes' where his children can see.

My question is if he can say this? Is it illegal to be intimate in your own backyard? It *is* your property. Or, because windows face your yard, do you have to be wary of your neighbors?
