Modified military ID

ok my wife and I are in the National Guard, one day my wife made her ID card say she was 21 just to see if it works, well she dropped her ID card and got caught, my question is I know National Guard is not subject to UCMJ unless IDT or federalized can anything happen to her she did not change her ID on drill weekend

Yes and No.  You are correct that it is not punishable under the UCMJ unless she was on orders.  With that said however if she ever possessed the id while on drill weekend or orders, she could be punished.  And damage to government property and falsifying a government ID will carry it's own punishment.  Your looking at probably a small fine and a little jail time.  Not too bad for what she did I suppose....

    This little blurb is from Art 2 of the UCMJ, the part stating who is subject to it.

    (3) Members of a reserve component while on inactive-duty training, but in the case of members of the Army National Guard of the United States or the Air National Guard of the United States only when in Federal service.

    Tell your wife I just administered a long distance slap upside her head, not as an ex nco but as a guy more than old enough to be her father.

    Guess it never occurred to either of you to just misplace the ID and get a new one.

    Drinking is highly overrated anyway! I can state well beyond the shadow of doubt that it gets you NOTHING but trouble. I started at 13 and quit, in the hospital, at 35. Have not missed it in those 18 years.

  3. Since when is the Guard not subject to the UCMJ when it has to do with military equipment or Military issue? Also she altered a Federal form, yeah she can be in deep dodo. But it still is up to her command to charge her or not.

  5. oh yes indeedy the NG is covered under UCMJ when it concerns this sort of stuff. she falsified a federal document.  at minimum she can expect an AR 15 hearing.

  7. When I worked in the ID office, we had a young airman make himself an ID saying he was 21.  He was discharged from the Air Force immediately upon discovery.  

    He abused his position and our thought process is what else is he doing and for what purpose?  I have to be able to trust my troops completely.  I don't know that your wife will be discharged but she should be.

  8. Falsifying a military/government ID is against the law. She may not face UCMJ charges, but she will be lucky if she does. If she is charged under the Federal Law, she could get a much harsher sentence.
