Question:

Motorway question?

If there are three cars driving on the motorway, the car in lane one decides to pull into the middle lane (lane two) at the same time the car in the overtaking lane (lane three) decides to pull into lane two and they both clash whose fault will it be?

Not happened to me but nearly happened to me today.

  1. If it TRULY happened at the same time, it'd be knock for knock. It's what insurance companies call "One Of Those Things" - where two people decide to use the same bit of road at the same moment.

    There's a lesson to be learnt here - indicate in good time!


  2. As far as i understand it, the car on the inner lane has right of way, as the car on the outside is the one overtaking, and has to give way. Bet someone will prove me wrong.

    is what happened to car 3.

    As i see things on the motorway, the inside lane is for trucks

    and various other hgv`s which cant get above 70 mph.

    The middle lane is for overtaking trucks and other hgv`s.

    The fast lane is for bmw drivers and big volvo cars.And myself

    who does not own a bmw or a volvo.

  5. A key rule of the highway code is that you give way ot the right.  This means that the car in the outside lane has right of way over the inside lane.  However, in a truly simultaneous situation it would be bad luck - 50/50.

    then switch to lane 2. then hit the brakes that'll teach him

  7. i think the insurance companies would class it as a 50 / 50

    because any vehicles that are or about too change lanes should be taking effective observations in mirrors and blind spots before changing direction if neither driver are doing so which sounds like the case then both drivers are at fault and both could face possible careless driving charges too if a case like this went to court the highway code could be used to determine blame of either party

  9. Probably classed as "knock for knock" if it could be proven it happened simultaneously, and the perception of any witnesses.
