Need information on about insurance settlement?

If my lawyer wants me to go to court for settlement from a car accident, and I decide I would rather settle out of court instead of going to numerous hearings, etc., can I still settle w/ the insurance of the person who hit me instead of going to court even though he has already started filing papers in court?

  1. Yes, but your lawyer still gets his cut.  And the insurance company won't deal with you, only your lawyer.  But your lawyer has to do what you say.  So if you say, negotiate a settlement out of court, he has to do it.


  2. who do you think you are goin gto court against?  most likely, his insurance company.  you can settle any time you want!

  3. Yes, you can settle earlier with out going to the trials. If you accept the amount of money offered that is it.

    If you go to court and have the trial you stand a chance to possibly get a higher settlement amount, or maybe none. Probably not the case if there was already an offer made.

    I didn't settle, I refused the first monetary offer, then the second, refused that too. It was to my advantage I took it to trial with my lawyer because I ended up with almost double the amount of the first original offer.
