Non-payment of salary!?

In this economic environment, unfortunately I am working for a firm who have had to make some employees redundant. Those that are left are still working but haven't been paid for two months! We have been promised there is money on its way? How does this affect your NI contributions? I can't survive any longer with no money but am worried that if I find another job - which won't be easy - I am the wrong side of 55! - I might never get my salary! I love my job and the company but there are limits! Any help/advice would be appreciated?

  1. sounds like the company are telling porkies and any day now will go into liquidation and therefore you'll never get the money owed to you

Talk privately with your employer and negotiate for a payment as soon as possible as you cannot wait any longer.  Ask them to be truthful about the company's financial future.  They owe you that much.  File a complaint with the Department of Labor or the appropriate ministry in your district.  Only do this if it looks like you will never get paid.   Pray for the best.

If you ever DO receive payment, take the check immediately to THEIR bank and cash it; then go deposit the cash in your bank.  Sometimes companies issue paychecks with only enough cash in the bank to cover SOME of the payroll but not all of it.  They are counting on the fact that not all employees cash/deposit their paychecks right away.  If you deposit the check at your bank and wait for it to clear, you may be one of the unlucky ones.  So if you do get a check, go directly to THEIR bank as quickly as you can (does not matter if you do not have an account there) and cash the check.

  4. Assuming you work in the UK...

    Difficult situation! However if you do get another job and resign from your current job and the company fails to pay you everything they owe you then you would have a potential case that could be taken to an employment tribunal - for unlawful withholding of pay. However, if the company doesn't have any money it may be a Pyrrhic victory.

    Suggest you go and get some advice from your local Citizens Advice Bureau if you don't get paid soon.

  5. You will have to file a claim with the Wage and Hour board in your state. If you are salaried, they will refer you to the people who will help you. This could take a little time as the company you work for will have to respond to your claim. But yes, they have to pay up.
