How do I go about giving my ex partner Parental Responsibility? Legally, as my daughter was born before December 2003 and we were never married, he doesn't have it. What forms would I need? And would we need lawyers?

  1. You must establish paternity through DNA testing.  Call the Family court in your area.


  2. hi , if u live in scotland , u go see a soliceter then go to a place in edinburgh pay £ 20 and u get an offical letter , stating myself and my partner did that ,, as soon as you pay the money he has right that what happened with us ,, hope this helps x

  3. i had to do the same thing for my ex partner as its vital for them to have parental responisbilty when looking after your child. you can both go to the same lawyer and tell them what you want to do it could be as simple as you and your x signing some paperwork and you could avoid court.

If he signed the birth certificate, you can file for child support (that's what you mean by "parental responsibility", right?).  Even if he contests paternity, a child support order will still be granted, because he acknowledged paternity by siging the certificate.  He would have to fund a DNA test himself, if he wanted one.  You don't need an attorney for this, as it's very simple.  You simply fill out the forms (found in the courthouse or the courthouse's website), send it in and wait for your court date.  

  6. If he has signed the birth certificate he has parental responsibility, the law changed in April 2002, before that they had no rights



    My son was born in May 2002 and unfortunately my ex has PR, we are trying to get this taken off him as my husband is adopting my son, my ex is a looser and hasn't seen my son in over 4 1/2 years
