My friend and I have been arguing this point for a long time. If I would flick a police officer off will I get arrested. (By flick off I mean show him the middle finger.) If you say I will than what will I be charged with.

My stance is that I won't

  1. Depending upon what day the police officer has had and who else can see the flick.  Say in front a group of nuns or kids - then yes offensive behaviour.  At 3am in a nightclub - nup too much hard work.  As said before though may give the door opening to speak to you and find all the crack in your shoes :)

  2. Okay I don't quit understand the question it's worded weird. But see if this helps.

First off flicking off a police officer in of itself isn't illegal. BUT if you are already being arrested than they may just call it assault or some other bogus charge. (No it's not right to flip them off but it's not something to get worked up about.) I personally think it depends of the officer and how his day is going and how his general attitude is. But I'm sure that with any specific charge relating to flipping them off your lawyer could get you off with just an apology letter or something like that.

As for the original charges of the arrest that's a different story.

I hope this is what your looking for.

  3. While not illegal, flipping off an officer would make that officer think, "Hmm, why is this person doing that?"  They would then have the reasonable suspicion to start an investigative stop on you to figure out the malfunction.  A good way to get uneeded attention.
