Question:

Pregnant and on Workers Comp?

by  |  earlier

I have been on workers comp for a year. I was scheduled to have surgery this last Tuesday. The week before my surgery I found out I was pregnant. The doctor will not go ahead with the surgery until after I deliver which won't be until April 2009. So my question is will I still recieve my normal workers comp checks until I get surgery or can they take it away? Thank you in advance.

  1. In order to answer your question accurately, I would need to know the state in which you are employed, how long you have been employed, and whether you are a full time or part time employee.

The reason these details are necessary is due to the nature of your current situation.  That being the coverage under the FMLA.  I would need to know these details to determine if FMLA is running during your workman's compensation case or not.  This detail will make the difference in whether your checks will continue.

I will look for additional details added to your question or if you prefer, you can send me an email with the additional details.  Congratulations on your pregnancy.

    Best wishes.
