does anyone know what the max/min prison sentence for tax evasion and fraud could be? I have a family member whos in trouble for refusing to pay income taxes(alot of it) and then conspiring and hiding their money from the IRS. They're in alot of trouble. This is a federal offense isn't it? I'm just wondering where I could find info on what kind of punishment they could face. I don't have the ability to ask them directly

  1. Up to 10 years for violation of 26 USC 7201.  Wesley Snipes was convicted of violating 26 USC 7203, a misdemeanor, and will face a maximum of one year on each count.

  2. This matter depends on the amount of the tax evasion,(How much money is involved.)How helpful they are in assisting the IRS in correcting the problem, and since this is a Federal matter I don,t think the state they are in is a issue. For information on their punishment you could go to your local law library and ask the clerk there to assist you on federal statutes,They will be helpful if you tell them what you seek.

  3. It varies with how many charges they are facing and the severity of the charges.

Irwin Schiff, a well known tax protester got 13 years and Wesley Snipes is looking at 10.  Sherry Peel Jackson, the former IRS Agent turned tax protester got 7 years but Larken Rose, a minor yet very vocal tax protester, only got 10 months or so.

If they kick and scream the entire time and do not cooperate, they are looking at going away for a very time long time.  If the cooperate and pay up, the judge may go easy on them.
