  1. Helmet laws vary from jurisdiction to jurisdiction.  Each state sets their own helmet laws, then each county within that state can make those laws more restrictive.  Then each city within that county can make them stronger.

The state's helmet laws apply to motorcycles.  The county can put into place helmet laws for scooters and bicycles.  The city can regulate scooter and bicycle use on roads or sidewalks.

So the only way to know for sure is to call the local law enforcement agency and ask.

  2. Even if it's legal to ride a push scooter without a helmet, is it smart to?

If you get into an accident with your scooter you will be much better off if you wear head protection than if you do not.  Think about it this way:

A car driver runs a red light while you are legally going through the intersection, even though the accident is totally the fault of the car driver, who is going to get hurt worse?  You are, dude!  I have yet to see an accident between a car and something smaller than a car where the driver of the car was more seriously injured than the other person involved in the accident.
