Our upstairs apartment neighbor is very noisy. I have complained to the manager three times now. They tell me to call security, which I have twice. The noise continues. I have had the neighbor across the hall come over to my apartment to listen and witness the noise. I also have recorded the noise which usually last till 11pm at night, sometimes 12. What can I do? What right do I have. Manager suggests I move to third floor to avoid noise at my expense.

  1. What kind of noise? What was the outcome when security was called?

Partying, loud music? Call the police and get a report made. After continued reports, you have proof that your right to quiet enjoyment is being compromised. The landlord should take action.

Normal living noises? Walking around? TV? Loud voices? Are you expecting silence? This type of noise is part of apartment living and little can be done. It's hard for a landlord to take action in this case.

  2. Here's an article explaining someone else's experience in Missouri and what they did about it.  The best advice is to find the local tenant's association to find out what your rights are.  In Boone County, the Tenants Association can be found at 573-882-7670.

  3. You have the right to complain, and you have the right to move. Sorry, but this is what apartment living is all about. If you want silence, find a nice cave.
