Question:

Shared boundary, access issues?

Does anyone have any advice on the following...

We (my Girlfriend and I) live in a upstairs flat in a house that has been divided into two properties. Both flats have access rights in the deeds to the garden that adjoins the downstairs flat.

Since new neighbours moved in below they have erected a shed and are planning to install french windows that will open onto the shared garden.

We feel that this changes the access and use of the garden and could effect the value of our property negatively. Whilst we have never used the garden whoever buys our flat when we sell might wish to, if the garden has been laid claim to in this manner it is unlikely they ever would.

What annoys particularly is that they never asked, we probably would have said yes. Right now I just want to know where we stand legally?

If anyone has any thoughts on this I would really appreciate it, especially if you've experienced anything similar

  1. sounds like they are trying to completely claim the garden as their own, which is not fair, have a talk with them and tell them how you feel maybe some compromise can be reached. very rude of then don't you think.best of luck to you. ....also a think you have a legal right to approve of any improvements or changes they want to make
