Speaking of my accident...?

First, I live in PA. I had limited tort...if you dont know what it is, then dont bother...I was in an accident about 2 months ago. I was rear ended, pushed into the car infront of me, and they were pushed into the car infront of them. I didnt go to the hospital RIGHT away, but went later on in the day. I didnt have any broken bones, or anything too serious. But, I've been going to physical therapy, getting treatment. My back hurts every single day. I cant work because Im a care giver which requires alot of lifting and whatnot. Not to mention, sometimes my knee, my pelvic area hurts, and I also have numbness going down into my fingers. I got an MRI last monday, Im waiting for the results. I was wondering, since Ive been having pain for over 2 months, and not able to work, does that "qualify" for pain & suffering with limited tort?

  1. If you have a smart  attorney, he will be able to tell your doctor what injuries and pain and suffering you have.   :>)

  2. if it wasnt reported at the time of the accident, you might not have enough evidence to prove it happened then. insurance fraud is so common, theyre really cracking down. you should have went to the doctor, then brought dr. papers to the police station to add to the accident report.

  3. with limited tort, you can't sue for pain and suffering.  you can only sue for the amount of losses.  for you that would include medical bills and lost hours from work.
