Statutory rape laws in Ohio?

I am 17 and will be 18 in October. My boyfriend just turned 18 in May.

I found out I am pregnant and one day one of my brothers was being dumb and asked my mom " what would you do if sis's boyfriend got her pregnant?"

My mother said she would turn him in because I am still underage.

I have looked up the laws and they say anyone 18 and over being with someone between 13-16 can get into trouble.

So my question is since I am almost 18 if I am to tell my mother could they do anything about it legally??

Here is the Ohio law: No person who is eighteen years of age or older shall engage in sexual conduct with another, who is not the spouse of the offender, when the offender knows the other person is thirteen years of age or older but less than sixteen years of age, or the offender is reckless in that regard.

    If you just found out you are pregnant, there is no way you could have been 16 when you got pregnant.  Thus technically, it was not illegal for you to have s*x with him while you were 17.  Unless your mother has proof that you two were having s*x while you were 16 and he was 18 (not possible), he could not be charged with statutory rape.  However, two underage minors having s*x (if he was 17 when you were impregnated) could be charged as "unruly" in Ohio court.

    But yes, she could do something about it legally.  It's her right as your mother.  However, it doesn't look like he's going to jail or on the s*x offender registry list for it.  (And being "almost 18" doesn't matter.  You're still 17.)


  2. The age of consent in Ohio is 16. Your boyfriend was not breaking any laws when he had s*x with you.

  3. It was not legally rape because in Ohio you must be under 16 for statutory rape.
