THEFT QUESTION, STOLE A DVD?

I was shopping today in a store, when I was asked by the manager who was holding up a paper that had a picture of me which was taken by a survallence camera. I stole a dvd a couple months ago, and they were positive that it was me who did it. As we were walking to the security room, I told the store manager I had to leave because I was late for an appointment. The manager stated that " It was a private property and they can hold me until the police come". They said they wouldn't call the police, or call my parents as long as I signed a tress-passing agreement, and agreed to never go back. I showed them my I.D. to prove I was who I was signing as, and they let me go.

My question is...

Is there anyway they can prosecute me or take any actions?

If you go back they can do a citizen's arrest  for only trespassing.

You have not been convicted of anything and unless they have proof you left the store with the Cd the only legal recourse they have is to keep you out of the store.

Don't go back and quit stealing, if you get a conviction it can really mess your future up.

The standard is very high for a citizen's arrest to be used in shoplifiting scenarios for most corporations, since if they do a citizens arrest and don't get a conviction they can be sued for false arrest,whichh is big time liability.

I don't think so. If they were so sure it was you, then they would have either called the police or demanded restitution or both. The fact that they accepted a Trespassing Agreement indicates to me that they are satisfied and no further action would be taken. Was it you in picture? If it was, you got lucky with a trespass warning. If it wasn't you, then I wouldn't have signed the agreement, demanded that they call the police and have them prove that it was you in a court of law.

yeah, doesnt matter if it was 20 dollars or 20,000. stealing is stealing DA!
