Tomatoes are fruits, but because they aren't sweet like most other fruits they tend to get grouped with vegetables.

It's in the fruit family because it has seeds just like an avocado it's just not as sweet as most fruits but it has a sweetness to it.

Tomato is a fruit because it contains seeds in or on the body of the fruit and not on the stalk/plant/vine itself, and it is of a fleshy substance.  For that matter, cucumbers, squash, pumpkins, peppers, eggplants, and coconuts are fruits as well.
