Question:

Trial for Car Accident?

by  |  earlier

I was driving along a straight road and a car comes from the left and i hit it. The driver said she stopped at the stop sign but didn't see me coming. I thought it was obviously her fault so why is there a trial? How long will it last?

  1. Without more information concerning this accident, I would say that you can either contact your insurance company and ask them since they are protecting and insuring you or you can go out an ask a lawyer for advice.

  2. she may have talked to a lawyer  ask your insurance agent you may need one

  3. maybe a few days.

  4. You need a lawyer. The judge will estimate the time. You will need witnesses if you have some.

  5. A trial or a court appearance? You need to give WAY more details about this mess...

  6. I aggree with cwboybill, you do need to give us a lot more details.

    Was police report filed?

    Was anyone hurt?

Who was on the main road, and who was turning into the main road etc.

Have you contacted and made a claim on your insurance?

All of these are important in determining who is at fault.

And I would certainly contact a lawyer who specializes in road accidents, ensure you give him/her a through report of your position on the road, including her position on the road, prior to the collision and after the collision, where you were traveling too,  dates & time is also vital, and if a police report was filed, and the damage sustained to your car and hers.

As for the length of the trial can depend on witnesses, injuries sustained etc, so having a lawyer is vital to ensure your side of the story is heard.

    I wish you luck

  7. A trial is in a criminal court, do you mean a civil court, if so she is blaming you for the accident and or the Police are prosecuting you for a driving offence.

You will need to know exactly who is prosecuting you and for what.
