Void after 90 days?!

I worked for a company half way through March, I ended up quitting. That's not my problem, I let them know I was leaving, faxed them paperwork stating I was leaving, and just to forward my checks to my address. They left a voicemail on my phone a day later, stating that they couldn't forward my checks to my house because I had to sign for them or whatnot. I figured it wasn't a big deal because I had direct deposit, and figured they would go directly into my bank account. I ended up getting my paycheck in the bank when I was supposed to, and I left it at that, and thought nothing of it. I didn't think I had any other checks outstanding, and if I did, they would be direct deposited as well. Today I got an envelope in the mail that contained a pay stub, and a check for 280 dollars. Apparently the check for 280 dollars was supposedly my final paycheck. It's dated 3/29/08, and at the bottom it states void after 90 days. Of course I conviently got this today, almost exactly 90 days from the date on the check. What should I do now? Can I still cash it? Who should I talk to? If I would have known I had another check there, I would have picked it up, but no one ever said I had one! What's the best action to take now?

  1. i would cash it immediately. or I would have talked to them if you couldnt cash it and tell them they were stupid sons of b*****s for not giving you your check on time and then if they don't give it to you I would sue. I would also check and see what vacation time you have accumulated and ask for that too. call an attorney and save all your pay stubs.


  2. 1st go and try to deposit it at your bank or cash it at a branch of the issuing bank. If either bank says they cannot do it, then

    2nd contact your old employer. They can have that check reissued. It is still your money regardless.
