When will the warrant be issued?

About 4 days ago my boyfriend and I got into a dispute. I was very upset and mad at him so I went and filed a police report. I thought thats all i was doing but the cops founds a bruise and jumped to conclusions and took a picture and said it's now out of my hands and they were going to file charges against him. They said they had 72hrs to arrest him and then there would be a warrant issued. It's been 72hrs and still no warrant. Does it have to go to the DA's office first before the warrant is issued? What is the process. How do i get these charges dropped. Please no you need help and you did the right thing im not looking for simpithy im looking for answers.

Depending on the State you live in you may NOT be able to drop the charges. All they need is a Judge's signature to issue the warrant.

For the number one yes the police can make assumptions that can lead to the arrest of an individual for a crime they may or may not have committed. The police can take 72 hours to get a warrant but they would not need it, because they could just arrest him and hold him for 24 hours for questioning. If they have enough reasoning to file charges they can hold him longer other then that they are forced to release him. Again they don't need the warrant for his arrest.

It all depends on what state you live in.....If your in CA theres nothing you can do per 273.5 of the penal code....he has to be arrested.
