Question:

Removed from lease without permission

I live in an apartment and my roommate is the building manager. She is not the landlord or owner. She gets reduced rent to deal with problems, collect rent, show vacancies, etc. We agreed when we moved in that I would pay the rent and utilities to keep things equal, which I've done faithfully for over a year. We are both on the lease.

We got in a fight and she decided she wanted me to move out. This apartment is ours, equally, whether she is the building manager or not, right? I think she lied and told the building's owner that I was moving out and had me removed from the lease without my permission. Is this possible or legal? If not, what recourse do I have?

  1. Her reduced-rent is a problem for you.  You probably were not doing any managing of the apartments so you personally didn't qualify for the "special" deal.  YOu might have to leave. /

  2. I don't think you can just be removed from a lease.  You should contact the building owner and if he can't help you there should be a tenant/landlord assocation for your area.

  3. Actually no, your lease is not covered by RE laws anymore, but employment laws.   I seriously doubt she is allowed a roomie, there are some major legal, tax and liability issues with your arrangement.

I do not see any way that you can legally stay, she legally is not living in an "apartment" but a "full time office".
