If your apartment lease is up can the landlord/management renew the lease without your consent?

  1. No, but...

    Check your current lease (or your immediate past one). There may be something in there addressing what happens at the expiration of the lease.

    Often, leases provide that an annual lease will revert to month-to-month. However, it's also possible that the lease provided something different--for instance, that the lease would automatically renew for a period of a year unless the tenant (you) notified the landlord in writing prior to the lease expiration that you did not wish to renew the lease.

    A lot of online services are like that, with automatic renewal. You have to say: "Stop" to make it stop and to get off the hook.

    Honestly, I haven't heard of that happening in a lease. But, technically, it could.

    However, check the terms and conditions of your previous lease. If your previous lease just calls for month-to-month, then that's what you (and the landlord) are bound to. If the lease is totally, completely silent on the matter, then when the lease expires, that's it. Gone. Poof.

    So, getting back to your specific question: No, a landlord cannot renew a lease without your consent. (Just make sure you didn't "consent" in your prior lease.)

Your lease must contain an automatic renewal clause...which is quite common.  You need to check your lease.  Most automatic renewals take place if the tenant fails to let the landlord know of his intentions not to renew within a certain time period prior to lease expiration.  This is why I can't stress enough to tenants to READ their lease BEFORE they sign.

  3. Read your lease!!!

    As already stated, if your lease contains and automatic renewal clause, your landlord has your consent to renew your lease.

    If you fail to give proper written notice letting the landlord know that you will be moving out upon the expiration of your current lease, you may be stuck for another full term.
