Renewing a judgement?

My husband had a car reposessed in his early 20's. He had a judgement filed against him for it and nothing has happened since. The judgement was filed in Pennsylvania back in 1994. My state has a 10 year limitation on judgements, but they are also renewable at 10 years. We are now 14 years from the judgement being filed and we have started to recieve letters from the company holding the defaulted car loan that got the judgement against him 14 years ago. They have never renewed the judgement. Is there a time limit for how long they have to renew this? Can they renew this at any time? Can they collect on an expired judgement?

  1. Keeping in mind that every state court seems to have different procedures, you will want to call your local court to verify this.  Also you can verify if the judgment was renewed, as it should be in your court records.

    But in most states, if the creditor has not filed for a renewal on time the judgment is vacated.

    And they can not file for a new judgment.

    So....once you find out this new collection agency has no leg to stand on...call them up and release a PMS rage on them!
