Rent situation...please help.?

Ok check it out. There was an ex-manager that used to be here at our apartments. My mother-n-law paid the rent and for about five months or so the manager wasn't giving the receipt to my mother-n-law. She say's she wasn't the only one but the manager took off with all the rent money. Now the Owner wants us to pay back rent but we have no proof that we paid the rent since it was cash. What can we do?????

  1. Sorry to say it, but without prove that you paid in cash looks like you'll be paying again.

    Sorry, but that's the truth.

    No one should give anyone cash for any bill without walking out the door with a receipt right then, or at least paying them by check so you have the canceled check as a record.

    I would also do a little investigating...was it just you or is this happening to other tenants.


  3. You should have paid by check if you did not immediately get a receipt in exchange for the cash.  Without a receipt or canceled check, I don't know how you would prove what you paid.

    But the landlord was clueless if he did nothing if rent from anyone was missing for more than a month.

  4. If you have a bank account and can prove that you took the money out (has to be at or around the same amount as the rent), show that to the courts..should it go to eviction court. Inform the judge of how the ex-manager did not give your mother receipts, also get other tenants to appear in court with you or have them give NOTARIZED statements.

    Learning from past mistakes, I no longer pay in cash because of the same reason. Only I gave my money straight to the landlord, the only thing that saved us was the fact that my landlord came to court acting like a huge a@@ and got the case tossed out.

  5. If the landlord decides to evict or sue you for the rent, you are going to lose the case unless you have some kind of proof that payment was made.
