Renting an apartment and have a question.?

I plan on getting an apartment with a friend. My friend stated that she doesn't have to be put on the lease or do a credit check, if I do everything. Is was my understanding that all occupants over the age of 18 have to be put on the lease and do a credit check. Can someone point me in the right direction on where I can find somewhere that states that?

  1. Some leases also specifically state that it's a violation of the lease for you to have someone living there that is not listed on the lease.  We evict people where I work for this.  It's partially a safety issue (as we do criminal and s*x offender background checks on all of our residents)--how would you like to know the place you moved to let's just anyone who feels like it move in as long as one person is responsible?

We do credit/background checks on everyone over the age of 18 ,even if they are not going to sign the lease and just be a occupant.That being said,you are setting yourself up for a disaster.You will be the sole party responsible for everything that happens and all money.I've seen this happen too many times.Be careful.

I may depend on the state.  You should probably contact a real estate broker just to make sure.  Even if you are the only person who approaches the landlord they may want to evaluate everyone who will be living in the apartment.  Some may make YOU solely responsible for covering the rent if the other party does not qualify.  

  4. In CA she does.   She needs to fill out an application and sign the rental agreement.   She has to identify herself.  She may not have to do a credit check, that is up to the landlord and is not required by law.

  5. Not necessarily.  Some cities do not require all occupants over the age of 18 be a legal signatory on the lease.  That being said, you really want to protect yourself and have her sign.  You are taking on a large financial responsibility.  If she does not pay her portion of the rent, you must.  If she decides to leave, you are responsible for the entire rent.  And, if she does any damage, you are responsible for that if she is not on the lease.  If her friends come over and do damage, you are responsible for that.  I have seen way too many roomate situations turn bad for the one person who signed the lease and truly feel the financial burden is worth considering.
