okay so I was wondering what makes a in home apartment illegal...I know you need to have at least (I believe) 2 exits and have certain size windows...but what else could make it illegal? Also do you need to register it to the IRS even if its technically not considered an apartment because it doesn't have a stove?

  1. You do not register with the IRS, but you do pay income tax on rent collected.

You have to have a door that locks and windows that can be used as exits in case of a fire.    You have to have a heat source.  You have to have a means to cook food.   You have to have a smoke detector.   You have to have a means to obtain water and electricity, although you do not have to pay for these things.   You also do not have to provide fuel for the heat source, but it has to be available for the renter.

There are other state and even city requirements depending on your location.
