Report my phone broken get a new 1 ?

i have the Nokia 6133 but i know someone who wants to sell me there mest up blackbreey pearl. if i buy this broken blackberry can i go to tmobile and tell them that this is my phone and it broke and id like a new 1 ? would there be any cost ? [i have the $5 insurance]

Nope, the phones have an unique serial number and this is recorded with T-Mobile so they know for which phone you have paid the insurance.
