AHHH! help!!!! Ok, let me start by defending myself, my hubby and I are in substantial debt from medical bills are daughter has from a birth defect. We bought a car awhile back. We are having issues paying the bill cause of how high the payment is. Our bill was due last month and we didnt have the money so I "forgot" to sign the check we gave them. Yes I know not cool I dont want to hear it, if you had to choose between feeding your kids or paying your car bill you would do the same! They still tried to cash it and it obviously bounced...duh. Isn't it illegal for them to forge my signature in order for them to cash a check? When I spoke to them on the phone, the lady started being rude so i asked to speak to a supervisor, I was polite, i even said please! She than said, "If you speak to a supervisor i WILL put your car into repo review today...do you still want to talk to him?" I said yep! Also, isn't it illegal for them to threaten me like that? I hate bills.

  1. OK, I am not trying to be mean but you need to understand 2 things.

    First original creditors are not bound by the Fair Credit Reporting Act so they can pretty much say anything to you that they want.

    Second for them to let you talk to a supervisor makes them look like they can't do their jobs.

    Now auto finance is what I do for a living and most all major lenders will not even start repossession proceedings until people have missed 3 payments, so you should be OK just get caught up as soon as possible.

    And remember open conversation is the key to keeping your car, always let your lender know what you can do and when.

  2. Are you sure that someone actually signed that check?  It's more likely that the check was put thru without any signature.   I've seen unsigned checks actually paid.  

    Basically you tried to play a delay game and it didn't work.  If you made acquisations or tried to play more games, you probably annoyed the person on the phone.  Do you think they've never seen the unsigned check game before?

    I bet her side of the story is much different.  Like she was trying to work with you and get a payment date for the bounced check and you demanded to speak to her supervisor.  The supervisor who would be chewing her out for not already repo'ing your car.

  3. You can try talking to them about making arrangements to make adjustments.  It does not sound like repossession was started.

    I am a little puzzled why someone with so many financial problems is planning to tour Europe, buy a large dog.
