  1. Once you are actually married, in a legal  ceremony, your wife can apply to sponsor you to be considered for  approval as an immigrant to the USA.  The process takes some time.

If you  have been convicted of a criminal offence, and served a sentence in prison, you may be denied entry to the USA, permanently. Unpaid debts can also result in  you  being denied entry.

Your education or lack of it may also be a reason for being denied . You need to do some research on this subject on the Internet. Read the US State Department's website about the process of immigration.

    Jim B. Toronto.

  2. Since you're not married yet, she can apply for a fiance visa for you (K-1 visa).

Here is a bit of reading for you on the topic:

And a guide on how to obtain a K-1 visa:

I don't know if whether you mentioned a criminal record implies that you have one, but the one thing I can tell you is to answer questions truthfully when asked if you have committed this or that. Check yes in the box, don't lie, because US authorities can find out.

  3. A spouse visa requires 3 income tax returns from the 3 years prior making application for visa. The tax returns show the American has above poverty income. You have to be married for 1 year. And, you have to fill out paperwork for two different packets, fingerprint, interview, medical exam. You still won't have the Work Permit nor a driver's license.

No marijuana busts of any size. Nullifies everything.

    No felonies.

To immigrate, that takes a waiting list.

To get a Green Card, that takes an employer willling to sponsor you for their available job. Preference given to health care and baby care professionals. They do offer a lottery of 65,000 Green Cards, but note all the tickets for the 2008 prizes have been sold.

In short, they have clamped down on legal immigration, but the Illegals already in-country want special treatment and automatic residency for breaking the rules.
