ICAO doesn't determine the airworthiness of an aircraft. The individual aviation authorities governing each country does. In this case, it's the FAA.

Once you've gotten that far, you have to determine what type of aircraft you're trying to determine airworthiness for. An experimental aircraft has much looser requirements than does a transport-category aircraft.
