  1. The rule for that is whether it puts the subject at greater harm than if they were not participating in research. For instance a university recently did a study on e-mail scams by sending out bait e-mails to people and measuring the response. The subjects didn't know they were part of a study, but it is legal because they were not in any greater danger than normal.

  3. Nobody needs "permission" from "the government" to do "research" in the US or Canada.. There are specific materials, access to which is controlled (e.g., marijuana), upon which research is restricted to holders of government permits.  Any research which imperils the subjects or invades subject privacy requires that the researcher obtain permission, not from the government, but from the subjects.  Any medical or biological research must be approved by an institutional committee, from the institution whose faculty or staff are performing it, to ensure that proper permissions have been obtained from the subjects by informed consent and filed for review when needed.   Failure to comply with applicable laws can result in complaints to Federal or State/Province law enforcement agencies, who may choose to prosecute the investigators,  but there is no government agency empowered to generate such complaints without citizens making them.  Only if somebody dies, or is injured, can the government stick its nose in unasked and uninvited.
