  1. What type of visa has she been here on?  Some types do not allow residence or a change of status to an immigration-class visa such as a spousal visa.  She cannot get authorization to work until her visa status is sorted out, so of course her work authorization application was denied.  She needs to wait until there is a determination.


  2. Is her husband Cuban or is he an American?  It makes a difference.

    *************She was denied because he's not an American citizen.  She must go home and wait for a visa to become available.  For the spouse of a green card holder that's about 5 and 1/2 years.  She cannot wait in the United States.

    If he was an American citizen, instead of 200% Cuban, she'd be able to stay and live in the United States and get a green card.
