Resisting/Obstructing officer?

I was recently at a HUGE house party in Milwaukee. I came to the party late and opted not to drink. There were so many kids at this party, several of us went up to one of the bedrooms (along with one of the residents) and sat. An hour or so later the party was busted. Before I knew it, the bedroom door slammed shut and we were locked INSIDE the room. There was a padlock on the outside of the bedroom door. We were locked inside the room for several hours. Some of the girls were uriniating in wastepaper baskets. Most of us fell asleep on the bed. Finally the cops came and cut the lock off the outside of the door. Everyone was given a breathalizer. I blew a 0 - however I was given a situation for Resisting/Obstructing an Officer. I have already pleaded not guilty and my pre-trial is tomorrow - what are my chances of getting out of this?

  3. From what you have written I don't understand why (or indeed how) you were charged with obstruction.

  4. Zero. There are too many probable causes to convince a judge dismiss your charges.

  5. You have  a good case.  Nothing in your question hinders on resisting/obstructing an officer.

Don't sweat it.  You are a victim of circumstances.  You should be fine because none of what you wrote constitutes Resisting Arrest OR Obstructing and Officer in the performance of his/her duties.  The person that padlocked the door could be charged with obstruction... but not you.  You, could file kidnapping charges on THAT person... but they can not hammer you.  They were probably pissed that they had to wait to cut the lock off and found you guys in there and could not get you on the Intoxication charge so they tried to hand an obstruction charge on you.  Any judge in America will see you are not guilty of that crime.  Alot of people forget.  You don't have to beat the crime.... just beat the pending charge!  THEN YUZE A FREE MAN!  After I beat that wrap, I would consider contacting an attorney and suing that police department for "False Arrest" (because even a ticket is technically an arrest).  Maybe that would get the police chief to get their officer more training and attend legal update courses.  You do have a good case with that!

Ok whoever put the padlock on the door should charged with unlawful imprisonment and violation of fire codes and probably wanton endangerment, If I were you I would plead not guilty and make clear my intention to file charges and lawsuits against whoever it was that locked that door. all the rest of the girls who were locked in should do the same.
